Terms & services

Home / Terms & services

These terms explain how the Moiz shop works, how an order becomes a conversation with a representative, and what you may do with the electronics and digital products you buy. Please read them before you place an order. They were written for this shop, not copied from a marketplace that sells everything.

Agreement

These terms are the rules for using the Moiz shop at moizismaili.com and for buying the electronics and digital products listed there. By using the site, sending a message, joining the email list, or placing an order, you agree to these terms and to the privacy policy. If you do not agree, please do not use the shop. You may still read the journal.

We may update these terms when the shop changes. The date at the bottom of this page will move with any update. An order you have already placed keeps the terms that applied on the day you placed it, except where a change is required by law or is clearly in your favour.

The shop

Moiz sells a curated set of electronics and digital products. The photographs, descriptions, and prices on the site are an invitation to place an order, not a promise that every piece is on a shelf behind us at the moment you click. Colours on a screen shift with the screen. A blush strap may look warmer in your room than it did in daylight. Descriptions are written in ordinary language and are meant to be read with the specifications beside them.

We may add, remove, or correct a listing at any time. If a correction affects an order you have already placed, a representative will tell you before anything is final.

Who may use the shop

You must be able to form a contract where you live, and you must use the shop for yourself or for a household or organisation you are allowed to buy for. The shop is not directed at children. Do not place an order if you are not prepared to receive email about it. The email address you enter must be one you actually read.

Products

Each listing describes what is included. A headphone may include a cable and a case. A laptop listing will say if a power brick is in the box. A digital preset pack includes the files named in the description and the instructions we send with them, not a licence to the software you use those files inside, unless we expressly say so.

Accessories shown in a lifestyle photograph are not included unless the specification list says they are. A second pair of ear tips, a spare battery, or a strap is included only when it is written down. If something important is missing from a listing, ask before you order. We would rather answer than disappoint you.

Digital products

Digital products are files or access notes delivered by email after a representative confirms the order. They are licensed, not sold as objects. You receive a personal, non-exclusive, non-transferable licence to use the files for your own work, including client work you create with them, unless a listing says the licence is wider or narrower.

You may not resell the files, upload them to a public library, share a download link, or present the pack itself as your own product. You may show work you made with the presets or the sounds. If a file is defective, we will replace it or, if we cannot, cancel that part of the order. Because a file can be copied perfectly, we do not offer a change-of-mind return on a digital product once the files have been sent, except where the law where you live requires it.

Prices and availability

Prices are shown in the currency mark used on the site and include the price of the piece as listed. A crossed-out price is a previous price in this shop, not a promise about any other seller. We may change a price at any time before your order is confirmed. If a price on the site was wrong in an obvious way and you have already written to us, we will tell you and ask whether you want to continue at the correct price.

Availability is confirmed by a representative. A piece can sell through between your visit and that note. If we cannot supply it, we will not invent a substitute and charge you for it. We will offer a wait, a different piece, or a cancellation of that line.

Placing an order

You place an order by adding pieces to the bag and submitting the checkout form with your name, a valid email address, any useful note, and your agreement to these terms. The bag is stored in your browser until you submit it or clear it. Please read the bag before you submit. Quantities can be changed on the bag page.

Do not put a card number, a password, or an identity document in the note. The note is for human details: a finish, a question, a gift. After a valid form is sent, the page shows this confirmation: “Thank You! your order received, one of our representative will contact you.”

Confirmation, contract, and payment

The on-screen thank-you note means we have your request. It is not yet the moment a contract of sale is complete, and it is not a receipt for a captured payment. A representative will contact you at the email you gave. In that exchange we confirm the pieces, the total, how a physical item will be delivered or how a digital file will be sent, and how you will pay.

Payment is arranged in that conversation. The website does not take a card number. A contract for the pieces we confirm is formed when we accept the order in that follow-up and payment is agreed. If we do not accept an order, no sale is made and no fee is taken on the website. Please watch the inbox you typed, including its spam folder, so the confirmation does not sit unread.

Delivery of physical goods

Physical electronics are sent after the representative and you have agreed the practical details. We pack for a real trip. Risk in the usual way passes when the piece is handed to you or to the person you asked to receive it. Times we mention are estimates. Weather, carrier delays, and a missing reply from you can move a date. We will tell you when a delay is ours to explain.

You are responsible for giving a reachable email and, when the time comes, delivery details that are accurate. If a parcel comes back because those details were wrong, we will work with you on a second sending, and the extra carriage may be yours to cover.

Delivery of digital goods

Digital files are sent to the email on the order after confirmation. Check that the address is spelled correctly before you submit the bag. If a message with links or attachments does not arrive within two working days of our confirmation, write to hello@moizismaili.com and we will send it again. Keep the files in your own storage. We are not a long-term archive of your download.

Returns of physical goods

You may return a physical piece within thirty days of receiving it if it is unused, in the condition we sent, and with the accessories that came in the box. Write to us first so a representative can tell you how to send it. A change-of-mind return is for pieces that are not intimate in a hygiene sense where unsealing them ends the return, and not for digital files already delivered. Headphones that have been worn against the skin may be refused for a change of mind if the cushions cannot be resold, unless the law where you live says otherwise. We will say so clearly before you send anything back.

If we made a mistake, or the piece is faulty, we cover the reasonable cost of the return and we repair, replace, or refund that piece. Tell us within a reasonable time of noticing the fault. A battery that has simply aged after a long life is not the same as a battery that failed in the first weeks.

Faults and the maker’s promise

Electronics can carry a promise from the maker as well as your rights against Moiz. We will help you understand which door to knock on. Nothing in these terms limits rights that cannot legally be limited where you live. If a maker’s warranty asks you to deal with them directly, we will still answer questions about the order itself.

Acceptable use of the site

Use the site lawfully. Do not probe it, overload it, scrape it in a way that degrades it for other people, or upload harmful code through any form. Do not use our photographs or writing to mislead someone about who you are. Do not place an order you do not intend to discuss with a representative. We may refuse a request that looks mistaken, abusive, or impossible to fulfil.

Intellectual property

The Moiz name, the logo, the writing in the journal, the product descriptions, the photographs we commissioned, and the design of the pages belong to Moiz or to the people who licensed them to us. You may share a link to a page. You may not copy the catalogue into another shop, train a model on our text and images and present the output as unrelated, or use our photographs in advertising for someone else.

Product names that are not ours remain the property of their owners. A listing is a description of a piece we sell. It is not a claim that we own every word printed on a device by its maker. Digital packs we sell as Moiz packs are our products or are licensed to us for resale, as the listing states.

Ideas you send

We welcome practical questions. We do not invite confidential product ideas. If you send a suggestion, you give us permission to read it, keep it, and use it without owing you a fee, unless we have signed a separate written agreement. Please do not send us anything you consider a secret.

Disclaimers

The shop is provided with reasonable care. Guides in the journal are general education about electronics and desks and cameras. They are not professional advice for your hearing, your posture, your electrical installation, or your business. Specifications can be updated by makers. Where a detail is critical, ask us to confirm it before you rely on it.

We do not promise that the site will be uninterrupted. The bag lives in your browser and can be cleared by your own settings. Keep a note of anything you must not lose.

Liability

Nothing in these terms excludes liability that cannot be excluded by law, including liability for death or personal injury caused by negligence, or for fraud. Subject to that, Moiz is not liable for indirect or consequential loss, for lost profits, or for loss of data on your own devices. Our total liability arising out of a particular order is limited to the amount you paid us for that order, unless the law where you live requires a different limit.

You are responsible for the devices you plug in, for backing up your files before you install a preset or a sample library, and for using headphones at a volume that does not harm your hearing. A product is a tool. It does not replace attention.

Privacy

Our privacy policy explains how we handle personal information. It sits beside these terms. Where the two speak of the same topic, they are meant to be read together. The privacy policy does not authorise a new fee, and these terms do not shrink the rights the privacy policy gives you over your information.

Whole agreement and general points

These terms, the listing you relied on, the privacy policy, and the confirmation a representative sends you are the whole agreement for an order. A note in a chat log or a social caption does not change them. If a court finds one sentence unenforceable, the rest stay standing. A delay in enforcing a rule is not a waiver of it.

We may assign the running of the shop to a successor who will honour orders already confirmed. You may not transfer your order to someone else without our agreement, except where the law lets a consumer do so.

Contact

Questions about these terms go to hello@moizismaili.com. Put “Terms” in the subject line. We reply by email. If a formal notice must follow a method required where you live, say so in that email and we will arrange a suitable channel for it.
